Ratio Decidendi

The court found that while the National Land Commission's revocation of the petitioner's title without a hearing was unconstitutional at the time, subsequent judicial findings established that the petitioner's title was acquired illegally and was therefore invalid. The court held that the reliefs sought had been overtaken by events, as the Environment and Land Court had already determined the illegality of the title in Milimani ELC No. 2054 of 2007 KACC v Paul Moses Ngetha & another (2020) eKLR. As a result, granting the orders sought would be futile and amount to an academic exercise, since the petitioner had no valid claim to the property. The petition was therefore dismissed.
