Ratio Decidendi

The court found that the applicant was entitled to judgment for the certified costs of Kshs 152,950 as the certificate of taxation had not been set aside or altered, and there was no dispute as to retainer. The respondent was served but did not oppose the application. Section 51(2) of the Advocates Act provides that such a certificate is final as to the amount of costs, and the court may enter judgment accordingly. The court also found that the applicant was entitled to interest at 14% per annum from the date of taxation in accordance with Rule 7 of the Advocates Remuneration Order, as well as the costs of the application.
