Ratio Decidendi

The court found that the applicant had obtained a certificate of taxation for Kshs 145,717/- which had not been set aside or altered, and there was no dispute as to retainer. The respondent was served but did not oppose the application. Section 51(2) of the Advocates Act empowers the court to enter judgment on such a certificate. The court also considered Rule 7 of the Advocates Remuneration Order, which allows for interest at 14% per annum from one month after delivery of the bill. Accordingly, the court entered judgment for the applicant for the certified costs, with interest at 14% from the date of taxation, and awarded costs of the application to the applicant.
