Procedural Posture

Miscellaneous Application / Ruling on Garnishee Application

  1. 1 Whether the garnishee order nisi should be made absolute against the Garnishee bank.
  2. 2 Whether the Garnishee was under obligation to preserve the attached funds upon service of the garnishee order nisi.
  3. 3 Whether the Garnishee is liable to pay the decretal sum to the Applicant.

Ratio Decidendi

The court found that the Garnishee was served with a garnishee order nisi when there were sufficient funds in the account to satisfy the decree. The Garnishee was under a legal obligation to preserve those funds and not to release them to any other party until the court either made the order absolute or discharged it. The evidence showed that the Garnishee allowed the funds to be paid out to other creditors after service of the order nisi, without providing proof of when other garnishee orders were served. The court concluded that the Garnishee knowingly depleted the account in disregard of the court order, thereby frustrating the Applicant's right to recover the judgment debt....
