The application was filed without unreasonable delay. Although the applicant had not furnished security for costs, the court held that security could be ordered as a condition for granting stay. The court exercised its discretion to grant a stay of execution pending appeal, subject to the applicant depositing Kshs 200,000 as security for costs within 30 days, failing which the stay would lapse. Each party was ordered to bear its own costs.
