Ratio Decidendi

The High Court lacks jurisdiction to entertain the petition as the dispute concerns internal management and disciplinary actions within a company classified as a water service provider under the Water Act 2016. Such disputes are to be addressed first to the Water Services Regulatory Board, and employment-related matters fall within the exclusive jurisdiction of the Employment and Labour Relations Court. The petition is also sub-judice due to a similar matter pending before the ELRC. The court, therefore, must strike out and dismiss the petition and the related Notice of Motion for want of jurisdiction and for being an abuse of the court process.
