Ratio Decidendi

The court found that although there was inordinate delay by the appellant in prosecuting the appeal, the law requires that directions be given before an appeal can be dismissed for want of prosecution. The court acknowledged its inherent powers to dismiss an appeal in exceptional cases but held that, in the interest of justice and considering both parties' rights, it would not be just to dismiss the appeal at this stage. Instead, the court ordered the appellant to file and serve the record of appeal within sixty days and awarded throw away costs to the applicant, with a warning that failure to comply would result in automatic dismissal of the appeal.
