Procedural Posture

Criminal Revision / Ruling on Application for Revision of Bail/bond Cancellation

  1. 1 Whether the applicant was denied a fair hearing before cancellation of his bail/bond.
  2. 2 Whether the principles of natural justice and Article 50 of the Constitution were violated by the trial court.
  3. 3 Whether the bail/bond terms should be reinstated.

Ratio Decidendi

The trial court erred by cancelling the applicant's bail/bond without affording him an opportunity to be heard, thereby violating his constitutional right to a fair hearing under Article 50 and the principles of natural justice. The applicant, having already been granted bail/bond, had a vested right to liberty which could not be withdrawn without due process. The absence of a hearing before cancellation rendered the process procedurally unfair. The High Court, therefore, found it necessary to revise the trial court's decision and reinstate the bail/bond terms, subject to the applicant reporting to the investigating officer monthly until the matter is concluded.

Court Disposition

application for revision allowed; bail/bond reinstated with reporting condition
