Ratio Decidendi

The court found that although the applicant explained the delay as resulting from his former advocate's mistake, the application for extension of time to appeal was rendered futile because the subject property had already been transferred to a third party not party to the proceedings. The applicant did not rebut this fact. As a result, even if leave to appeal out of time were granted, the appeal would be an academic exercise with no practical effect. The court therefore declined to grant leave to appeal out of time and found no basis to consider a stay of execution, as the orders sought would be incapable of enforcement.
