The applicant did not contest this fact. As a result, granting leave to appeal out of time would serve no useful purpose, as the appeal would be academic and unenforceable. The court therefore declined to grant the extension of time and, consequently, found no basis to consider a stay of execution, as there was nothing left to stay. The application was dismissed with costs to the respondent.
