Miscellaneous Criminal Application / Ruling on Application for Resentencing

  1. 1 Whether the High Court has jurisdiction to entertain a further application for resentencing after a previous sentence review was determined by a court of concurrent jurisdiction.
  2. 2 Whether the applicant is entitled to a non-custodial sentence after prior sentence reviews.

Ratio Decidendi

The High Court lacks jurisdiction to entertain a further application for resentencing where the applicant's sentence has already been reviewed and determined by a court of concurrent jurisdiction. The cited provisions of the Criminal Procedure Code do not apply to the review of decisions made by the High Court itself or by another judge of equal jurisdiction. Entertaining such applications would amount to forum shopping and an abuse of the court process. The application is therefore dismissed for want of jurisdiction.

Court Disposition

application dismissed for want of jurisdiction

Orders

  • The application for resentencing is dismissed.
