Ratio Decidendi

The High Court lacks jurisdiction to review or resentence a matter where it has already determined an appeal on both conviction and sentence. The applicant's recourse, if any, lies with the Court of Appeal. The application for resentencing is therefore incompetent and must be dismissed for want of jurisdiction. The court is functus officio and cannot sit in review or appeal over its own or another judge's decision of concurrent jurisdiction. The applicant's arguments regarding the constitutionality of the life sentence and alleged violation of rights cannot be entertained at this stage by the High Court, as the proper forum is the Court of Appeal.
