Ratio Decidendi

The court found that while the respondent had a valid and fair reason to terminate the claimant's employment due to the accident, there was no evidence that the claimant was subjected to any disciplinary process or given an opportunity to defend himself as required by section 41 of the Employment Act. The absence of procedural fairness rendered the termination unfair. The court therefore declared the termination unfair for want of procedural propriety and awarded the claimant one month's salary in lieu of notice and one month's salary as compensation, considering the short duration of employment and the claimant's contribution to the dismissal.
