The Tribunal found that the Claimant had an outstanding loan arrears at the time of resignation, as evidenced by the Loan/Share Statement of Account and corroborated by the Respondent's witness. The Tribunal held that, pursuant to Section 36 of the Sacco Societies Act and established Sacco practices, the Respondent was entitled to exercise a first charge over the Claimant's deposits and refuse refund until all debts were cleared. The Claimant's resignation was also found to be procedurally defective, as he failed to give adequate notice and did not comply with the requirement to clear all liabilities before termination of membership.
