Ratio Decidendi

The court held that while parties generally have the right to withdraw applications or suits before hearing, this right is curtailed once the matter has been fully argued and is pending a ruling or judgment. At that stage, the application ceases to be within the applicant's control for withdrawal and must be determined by the court on its merits. Allowing withdrawal after arguments would prejudice the opposing parties and undermine the overriding objective of the Civil Procedure Act. The applicant's recourse, if aggrieved by the conduct of its former advocate, lies in a claim for negligence, not in seeking to withdraw an application after hearing.
