Additionally, the Plaintiff failed to obtain leave of court before instituting the suit against the 1st Defendant, which was under liquidation, as required by Section 56(2) of the Kenya Deposit Insurance Act. Both deficiencies were fatal to the suit, making it incompetent and defective.
