Ratio Decidendi

The court found that the appeal had been dismissed by operation of the consent order after the appellants failed to prosecute it within the stipulated 12 months. The subsequent application to review or set aside the consent order was also dismissed for lack of merit. With no pending appeal or valid application for reinstatement, there was no legal basis to continue holding the decretal sum deposited as security. The court therefore ordered the release of the funds to the respondents, as the conditions for their retention no longer existed.
