Ratio Decidendi

The Tribunal found that the Tenant was in rent arrears, as admitted by the Tenant and evidenced by the Landlord's statements of account. However, the Landlord's instruction of two auctioneers to levy distress for the same arrears was improper, as it exposed the Tenant to double charges and lacked evidence of withdrawal of instructions from the first auctioneer. The Tribunal held the proclamation by the 4th Respondent invalid. While the Landlord was entitled to levy distress for rent arrears, the Tenant had demonstrated willingness to pay and had made partial payments. The Tribunal granted the Tenant a rebate, reduced the arrears to Kshs 2,000,000, and allowed the Tenant until 31st January...
