The court found that although the respondent claimed the applicants' advocate was present at the delivery of judgment, there was no reason to doubt the applicants' assertion that they were only notified of the judgment on October 31, 2023, after the statutory period for filing a notice of appeal had lapsed. The applicants acted promptly thereafter by instructing new advocates and filing the application within about 10 days. The delay was not inordinate and was satisfactorily explained.
