Therefore, the applicant failed to demonstrate that the appeal would be rendered nugatory if stay was not granted. Since both limbs of rule 5(2)(b) must be satisfied for a stay to issue, and the applicant failed on the second limb, the application for stay of proceedings was dismissed with costs to the respondent.
