The court found that the judgment of the trial court was a negative decree, containing no positive order capable of execution, and therefore an order for stay of execution could not be granted. However, given the uncertainty regarding the nexus between the suit properties and the risk of prejudice to the parties, the court determined that the balance of convenience favored preserving the status quo. Accordingly, a status quo order was issued to maintain the current registration status of land parcel number Kiganjo/Kiamwangi/1070 for nine months, allowing the parties to prosecute the appeal without risk of the property being dealt with in the interim.
