The tribunal determined that its jurisdiction is strictly dependent on the existence of a landlord-tenant relationship as defined under the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act. The applicant had already been evicted from the premises before filing the reference, thereby terminating the landlord-tenant relationship. As such, the tribunal's jurisdiction was ousted, and it could not entertain the applicant's claims or grant the orders sought.
