The tribunal found that the landlord's notice to terminate tenancy, dated 18.10.2022, was issued before any valid interest in the property had been created in his favour, as the High Court only determined the beneficiaries of the estate on 30.3.2023. Under Section 7(2) of Cap 301, a landlord cannot rely on the intention to occupy for business as a ground for termination if his interest in the premises was created within five years preceding the notice. Since the landlord's interest was only created in March 2023, any notice based on Section 7(1)(g) could only be validly issued five years thereafter, i.e., from April 2028.
