The mistaken belief regarding the right of appeal was promptly corrected, and the application for extension of time and leave to appeal was filed within a reasonable period. The Court held that, prior to the coming into effect of Legal Notice No. 36 of 2000, leave to appeal could be sought from the Court of Appeal if not obtained from the superior court. The Court exercised its discretion in favour of the applicant, granting both the extension of time and leave to appeal, as the applicant had demonstrated diligence and there was no inordinate delay.
