Ratio Decidendi

The court found that the appellant would suffer substantial loss if the repossessed motor vehicle were released and its value diminished before the appeal is heard. The application for stay was filed without unreasonable delay. Both parties were obligated by the trial court's judgment to perform certain acts, and in these circumstances, the court declined to order security for due performance as a condition for stay. The need for expeditious hearing of the appeal was emphasized to prevent deterioration of the vehicle. Accordingly, a stay of execution was granted pending the determination of the appeal, with costs of the application to abide the outcome of the appeal.
