Ratio Decidendi

The High Court lacks jurisdiction to entertain appeals relating to work injury claims, as such jurisdiction is exclusively vested in the Employment and Labour Relations Court by virtue of the Employment & Labour Relations Court Act and relevant case law. The declaration of unconstitutionality of Section 16 of the Work Injury Benefits Act and the statutory framework under the Employment Act and ELRC Act make it clear that disputes and appeals arising from work injury claims must be determined by the Employment and Labour Relations Court. Consequently, the appeal before the High Court is a nullity for want of jurisdiction and must be dismissed.
