Ratio Decidendi

The court found that the injuries suffered by the appellant, namely amputation of the right leg at the ankle, were comparable to those in the cited authorities where higher damages were awarded. The trial court's award of Kshs. 1,500,000 was considered inordinately low in light of the severity of the injuries and prevailing awards for similar cases. Applying the principles from Kemfro Africa Ltd and after a fresh evaluation of the evidence, the appellate court held that it was justified in interfering with the quantum of damages. The award was therefore enhanced to Kshs. 2,000,000 in general damages, with costs of the appeal awarded to the appellant.
