Ratio Decidendi

The court found that the appellant's plea was unequivocal, taken in a language he understood with the aid of an interpreter, and the procedure for plea taking was properly followed. However, the trial magistrate erred in imposing a default sentence of two years' imprisonment for non-payment of the fine, as the Wildlife Conservation and Management Act does not specify a default sentence. Instead, the Penal Code's scale should have been applied, resulting in a default sentence of 12 months' imprisonment for each count. The appeal therefore succeeded only to the extent of correcting the default sentence, while the conviction and fine remained undisturbed.
