The respondent neither gave the claimant an opportunity to be heard nor proved that the reasons for termination amounted to gross misconduct. The backdating of the dismissal to the date of suspension without proper investigation or notification was deemed an unfair labour practice. Consequently, the termination was held to be unfair, entitling the claimant to compensation, salary arrears, notice pay, and a certificate of service.
