The High Court determined that both Sections 11 and 15(a) of the Civil Procedure Act are couched in mandatory terms, requiring suits to be filed in the lowest grade court competent to try them and within the local limits of the defendant's residence. The suit in question was filed in the Tononoka Children’s Court, which lacked territorial jurisdiction as the defendant resided in Malindi. As a result, the suit was incurably defective and as good as non-existent. The court relied on established case law, including Omwoyo v. African Highlands & Produce Ltd and Kagenyi v. Misiramo, to hold that the High Court cannot transfer a suit that was not properly instituted in the first place....
