The appellate court, after reevaluating the evidence, held that the appellant suffered multiple fractures and permanent disability, and that the trial court's award of Kshs. 450,000 for general damages was inordinately low and not commensurate with comparable awards for similar injuries. The court also found that the trial court erred in awarding only Kshs. 80,000 for future medical expenses, as the evidence supported the full claim of Kshs. 200,000 for removal of metal implants.
