The Tribunal found that the discharge of the Complainants from the committees of the County Assembly of Nairobi was procedurally unfair and unlawful. The 5th Respondent, having been suspended, lacked authority to initiate the disciplinary action, and the Complainants were not accorded a fair hearing before their removal, violating Article 47 of the Constitution and the Fair Administrative Actions Act. Furthermore, section 14(1)(4) of the County Governments Act requires every member of a County Assembly to belong to at least one committee, which was contravened by the discharge.
