The court found that the Plaintiff had proved, on a balance of probabilities, that it supplied pharmaceutical products to the Defendants, who failed to pay the sum claimed. The Defendants, as admitted partners in Afya Royal Clinics, are jointly and severally liable for the debt. Although the invoices stipulated interest at 3% per month on overdue accounts, the Plaintiff failed to prove when each invoice became due and did not claim interest in the demand letter. Therefore, the Plaintiff is only entitled to interest at court rates from the date of filing suit. Judgment was entered for the Plaintiff for the principal sum, interest at court rates from the date of suit, and costs.
