The court found that since the 2nd and 3rd defendants were joined to the suit at the instance of the 1st defendant, it would be unjust to deny them the opportunity to issue a third party notice if they believe the intended third party is liable for the debt in question. The court also clarified that, under Order 1 Rule 14(1) of the Civil Procedure Rules, such applications are to be made ex parte and that the plaintiff and 1st defendant have no right of audience at this stage. Accordingly, the court granted the 2nd and 3rd defendants leave to issue a third party notice against Pallinder Holdings Limited within 14 days.
