Ratio Decidendi

The court found that the trial court lacked jurisdiction to entertain the succession cause as the value of the estate exceeded the statutory limit for magistrates' courts under Section 48(1) of the Law of Succession Act. Furthermore, the petitioner failed to notify or obtain consent from other beneficiaries as required by the Probate and Administration Rules, and deliberately concealed material facts from the court. The grant was therefore obtained fraudulently and the proceedings were defective in substance. Consequently, the grant issued and confirmed in favour of the petitioner was annulled for want of jurisdiction and fraud.
