The court exercised its discretion to grant leave to appeal out of time. However, the court determined that the ruling sought to be stayed was a dismissal for lack of locus standi and did not constitute a positive order capable of execution. As such, there was nothing to stay, and the prayer for stay of execution was dismissed. The court ordered each party to bear their own costs.
