Ratio Decidendi

The trial court imposed a fine of Kshs. 200,000 for Count One, which exceeded the statutory maximum of Kshs. 100,000 provided under Section 102(3) of the Wildlife Conservation and Management Act. The High Court, exercising its supervisory and revisionary jurisdiction under Article 165(6) and (7) of the Constitution and Sections 362 and 364 of the Criminal Procedure Code, found the sentence to be illegal and excessive. The court substituted the sentence with the lawful maximum fine of Kshs. 100,000 or, in default, six months imprisonment. The sentence for Count Two was found to be lawful and was not interfered with.
