The court found that the preliminary objection raised by the current chairperson of the 1st respondent was identical in substance and form to a previous objection that had already been conclusively determined by the same court, albeit differently constituted, in a ruling delivered on October 30, 2019. The court held that all the elements of res judicata under section 7 of the Civil Procedure Act were satisfied: the matter in issue was directly and substantially the same, the parties were the same or litigating under the same title, and the issue had been heard and finally determined by a competent court.
