The court found that the applicant had demonstrated the possibility of substantial loss if the decretal amount is paid and the appeal on quantum of damages succeeds, given the unknown financial means of the respondent. The application was filed without unreasonable delay, especially considering the Covid-19 pandemic context. The court determined that part payment of the decretal sum (Kshs.80,000) would suffice as security for the due performance of the decree, rather than a bank guarantee. Accordingly, a stay of execution was granted on condition that the applicant pays Kshs.80,000 to the respondent within 60 days, failing which the stay would lapse.
