The court found that the Plaintiff never transferred the suit land to the 1st Defendant or any other person and retained the original title. The transfers to the 1st and 2nd Defendants were unsupported by any legal documentation required under the Land Registration Act and its regulations. The removal of the restriction on the title was not lawfully effected and was done to facilitate a fraudulent transfer to the 2nd Defendant. The 2nd Defendant, despite claiming to be a bona fide purchaser, had notice of the restriction and failed to exercise due diligence. The Land Registrar (3rd Defendant) was found to have been lax and complicit in the fraudulent transfer by registering the title...
