Miscellaneous Application / Ruling on Application for Enlargement of Time to Appeal

  1. 1 Whether the applicant has satisfied the criteria for enlargement of time to lodge an appeal against the lower court's judgment.
  2. 2 Whether the delay in filing the application for enlargement of time is adequately explained.

Ratio Decidendi

The court found that the applicant failed to provide a satisfactory explanation for the 5½ month delay between the dismissal of his appeal in the High Court and the filing of the present application for enlargement of time. The medical evidence presented did not relate to the relevant period of inaction. The court held that the criteria for enlargement of time, as set out by the Supreme Court in Nicholas Kiptoo Arap Korir Salat, were not met. Consequently, the application for enlargement of time to lodge an appeal was rejected for lack of merit.
