The Tribunal found that the Claimant did not serve the required notice of entry of judgment on the Respondent as mandated by Order 22 Rule 6 of the Civil Procedure Rules, rendering the execution process irregular. The Tribunal also noted that the Respondent's draft defence raised triable issues regarding the actual amount owed and the existence of negotiations between the parties.
