The High Court found that while the fine of Kshs 200,000 imposed for the offence of stock theft under section 278 of the Penal Code was lawful and within statutory limits, the default custodial sentence of three years' imprisonment for non-payment of the fine was unlawful. Section 28(2) of the Penal Code limits the default custodial sentence for fines exceeding Kshs 50,000 to a maximum of 12 months. The trial court's imposition of a three-year default sentence exceeded this statutory maximum and was therefore illegal.
