Ratio Decidendi

The Tribunal found that it had jurisdiction to assess and award damages in disputes arising from controlled tenancies under Cap 301, even where the tenancy had ended, provided the dispute originated during the existence of the tenancy. The landlord's failure to issue the statutory notice and the confiscation of the tenant's goods, some of which perished, constituted oppressive and high-handed conduct. The Tribunal relied on statutory provisions and case law to conclude that general damages were appropriate in this context. The tenant was awarded Kshs 23,000 in general damages for loss suffered due to the landlord's breach, plus costs and interest.
