The Court of Appeal found that the originating summons filed by the appellants was res judicata. The dispute over the suit property had been conclusively determined in previous suits, notably Nyeri HC OS No. 201 of 2000 (now Nyeri ELC No. 700 of 2014), where the court found that the suit property belonged to the Wainaina house and ordered its transfer from the 1st respondent to the 2nd to 13th respondents. The appellants, as members of the Karukenya house, or their privies, had participated in or were represented in those proceedings.
