Ratio Decidendi

The Tribunal found that the tenant failed to comply with the consent order requiring payment of Kshs. 320,000 in arrears by 30th November 2021. The consent expressly provided that failure to pay by the stipulated date would result in automatic termination of the tenancy. As the tenant did not pay as agreed, the tenancy was terminated by operation of the consent order. The landlords were therefore entitled to vacant possession of the premises, and the application for eviction and recovery of arrears was allowed.

Court Disposition

Application allowed. Landlords granted vacant possession and eviction orders against the tenant.

Orders

  • The tenant shall render vacant possession of the suit premises known as PLOT NO. B11/143 Meru Town to the landlords.
  • In default, the tenant shall be evicted by a licensed auctioneer.
