Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection

  1. 1 Whether the suit is statute barred under Section 4(1) and 7 of the Limitation of Actions Act.
  2. 2 Whether the court has jurisdiction to hear and determine the matter raised by the Plaintiffs.
  3. 3 Whether the 1st, 2nd and 3rd Defendants have locus standi to be sued on behalf of the deceased estate.

Ratio Decidendi

The court found that the issue of whether the suit was time barred could not be determined at the preliminary objection stage due to factual discrepancies regarding the date of the sale agreement. However, it was not in contention that the 1st, 2nd, and 3rd Defendants were neither administrators nor legal representatives of the estate of the late Loishorua Ole Kuyoni Mutonyi. As such, they lacked locus standi to defend the suit or to be sued on behalf of the deceased's estate. The court held that any action against the estate must be brought against duly authorised representatives, and proceeding otherwise would amount to intermeddling contrary to Section 45 of the Law of Succession Act....
