  1. 1 Whether the appeal was validly filed within the statutory timelines.
  2. 2 Whether the Tribunal had jurisdiction to hear an appeal filed out of time without leave.

Ratio Decidendi

The Tribunal found that the Appellant filed its Notice of Appeal on 4th September 2023, well outside the statutory 30-day period following the objection decision dated 9th December 2022, and did not seek leave to file out of time as required by Section 13(3) of the Tax Appeals Tribunal Act. The Tribunal held that statutory timelines for filing appeals are mandatory and must be strictly adhered to. Since the Appellant failed to comply with these mandatory requirements and did not apply for extension of time, there was no valid appeal before the Tribunal. Consequently, the Tribunal lacked jurisdiction to entertain the matter and struck out the appeal as incompetent.
