Procedural Posture

Civil Appeal / Ruling on Appeal Against Dismissal of Application for Revocation of Grant

  1. 1 Whether the appellant had locus standi to seek revocation of the grant in the estate of Kiura Mukono.
  2. 2 Whether the trial court erred in dismissing the appellant's application for revocation of grant.
  3. 3 Whether the grant was obtained fraudulently or by concealment of material facts.

Ratio Decidendi

The court found that the appellant was neither a beneficiary nor a dependant of the deceased, and her interest in the estate arose solely from her relationship with the 3rd respondent, who himself was not a beneficiary but a purchaser from a beneficiary. The appellant did not fall within the categories entitled to seek revocation of the grant under section 76 of the Law of Succession Act. The court held that the appellant lacked locus standi to present the appeal, as she had no legal interest in the estate. Consequently, the trial court did not err in dismissing her application for revocation of the grant, and the appeal was without merit.

Court Disposition
