The reliefs sought in the suit are for the benefit of all members of the Ngithi Clan, including the intended plaintiffs, and if the plaintiffs succeed, the process of ascertaining clan membership for land sharing will occur at a later stage. Joinder of all clan members as plaintiffs is neither feasible nor necessary for the expeditious determination of the dispute. The application for joinder was therefore declined.
